29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about November 22, 2023, employees engaged in powered industrial truck and warehouse operations at the meatpacking facility located at 2223 Industrial Road, Crete, Nebraska 68333 were exposed to struck-by hazards associated with the employer's failure to ensure that employee(s) had been properly evaluated before operating an industrial truck. In this instance, an employee operating a walk-behind pallet jack (mule), suffered a severe leg injury in the Challenge Room Area of the facility. The employee had not been evaluated operating that type of industrial truck.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): On or about November 22, 2023, employees engaged in powered industrial truck and warehouse operations at the meatpacking facility located at 2223 Industrial Road, Crete, Nebraska 68333 were exposed to struck-by hazards associated with the employer's failure to certify the employee's powered industrial truck evaluation. In this instance, an employee operating a walk-behind pallet jack (mule), suffered a severe leg injury in the Challenge Room Area of the facility and the certification of the employee's evaluation was not available upon agency request.
