29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section).  a) Guardrail system on second floor of warehouse; On or about January 24, 2024, and times prior the employer exposed employees to fall hazards, in that the employer did not provide a guard rail system that the top rail exceeded 39 inches. The top rail was at 36 5/8 inches tall to the top of the railing system.
