OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when working on an elevated platform on a forklifts without the use of a fall protection: On or about: November 30, 2023 Location: 1000 New County Road Secaucus, NJ 07094 a) Employees operated equipment that included, but was not limited to a Crown, Model SP 3020-30 Order Picker, to place merchandise on a warehouse rack system, elevating the platform to approximately 12-feet, without utilizing a fall protection system, exposing employees to fall hazards.

Employee operated equipment that included, but was not limited to a Crown Order Picker, Model SP 3020-30 to place merchandise in the warehouse and was not properly trained and evaluated to operate the equipment.
