OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by falling material and collapsing racks a) Warehouse: On November 8, 2023, and at times prior, the employer exposed employees to struck-by hazards, in that the ends of the blue industrial storage rack labeled "5" had bent and damaged supports as employees used powered industrial trucks to store and retrieve inventory from them.
