OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards when operating a forklift without the use of a restraint device: a) Loading Area, on December 5, 2023; an employee operated a Crown SC5245-40, S/N: 10161672 which was not equipped with a personal restraint system. b) Warehouse Area, on December 5, 2023; an employee operated a Toyota 7FBEU15, S/N: 13078 which was not equipped with a personal restraint system.
