29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Construction Site: On or about December 04, 2023, as the controlling employer, AVI Roofing & Gutters, Inc., did not ensure that its sub-contractor, X&M Roofing protected their employees in that employees were exposed to fall hazards of approximately 12 feet to the ground below while installing asphalt shingles on the first story of a residential roof. b) Construction Site: On or about December 04, 2023, as the controlling employer, AVI Roofing & Gutters, Inc., did not ensure that its sub-contractor, X&M Roofing protected their employees in that employees were exposed to fall hazards of approximately 20 feet to the ground below while installing asphalt shingles on the second story of a residential roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Construction Site: On or about December 04, 2023, as the controlling employer, AVI Roofing & Gutters, Inc., did not ensure that its sub-contractor, X&M Roofing protected their employees in that employees were exposed to fall hazards of approximately 12 feet to the ground below while accessing/egressing the roof. The ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder.
