29 CFR  1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields:  a) On January 30, 2024, Schaumburg Specialties, LLC did not ensure that welding curtains or other shielding materials were used around all workstations during welding operations to protect adjacent employees. An employee was welding/fabricating a larger mixing vessel in the Special Fabrication Area without using any type of screen on one side.   No abatement certification or documentation is required for this item.

The employer did not train employees in accordance with the requirements of HCS and paragraph (l)(2) of this section.  a) On December 4, 2023, Schaumburg Specialties, LLC did not include hexavalent chromium in its hazard communication program and did not train its employees in accordance with the requirements of the hazard communication standard and paragraph (l)(2) of this section. Employees were exposed to hexavalent chromium while welding on stainless steel to fabricate bakery carts, vessels and/or trollies.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a) On December 4, 2023, Schaumburg Specialties, LLC did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user.  An employee was permitted to use a 3M half face tight fitting negative pressure respirator with P100 filters while welding on stainless steel to fabricate bakery carts, vessels and/or trollies.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
