29 CFR 1910.132(d)(2): The employer failed to verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. On or about December 6, 2023, Bow Wow Graphics failed to conduct a hazard assessment for employees in the Washout Room that identifies different types of hazards and controls associated with operations occurring in that room. The operations include but are not limited to emulsifying frames in the darkroom of the washout room, washing the frames, and using chemical products during these processes including but not limited to Sherwin Williams Mineral Spirits and Easiway Systems Easistrip Supra.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. On or about December 6, 2023, the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for employees that use different chemical products including but not limited to Sherwin Williams Mineral Spirits and Easiway Systems Easistrip Supra to wash and clean the mesh stencil frames used to print words and graphics onto the garments the employer produces. The program must include how to train employees on hazardous chemical products used in washing operations, maintaining Safety Data Sheets (SDS) and where they are located in the facility, and how to identify the different hazards located in the SDS and labels on the containers for products.

Employers failed to have a safety data sheet (SDS) in the workplace for each hazardous chemical which they use. On or about December 6, 2023, the employer at Bow Wow Grpahics failed to maintain SDS for the chemical products they use in the workplace. This includes products used to remove ink and graphic material on the mesh stencil frames used to print designs and words onto the shirts including but not limited to Sherwin Williams Mineral Spirits, and Easiway Systems Easistrip.

29 CFR 1910.1200(h)(1): The employers failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about December 6, 2023, the employer failed to develop, maintain, and implement a training program and documentation to review for employees that handle hazardous chemical products for cleaning operations to remove the graphic ink from the mesh stencil frames used to print words and graphics onto the garments the employer produces. These chemical products include but are not limited to Sherwin Williams Mineral Spirits and Easiway Systems Easistrip Supra.
