Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about December 7, 2023, employees were conducting decking and roofing work on a new build gas station located at 9208 W Capitol Dr Milwaukee, WI 53222, without the use of fall protection. This exposed employees to fall hazards of approximately 10 to14 feet from the roof to the ground below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a) On or about December 7, 2023, employees conducting roofing and decking work without the use of necessary fall protection systems and/or equipment were not trained on the recognition of fall hazards associated with work being conducted or procedures to be followed in order to minimize these hazards.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. (a) On or about December 7, 2023, at a jobsite located at 9208 W Capitol Dr Milwaukee, WI 53222, employees were using an extension ladder to access the roof of a commercial gas station. The ladder did not extend 3 feet above the upper landing surface and was not secured at its top. This exposed employees to an approximate 10 to14 foot fall hazard.
