29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Excavation located at 4752-4792 Pittman Road, Cumming, GA 30040: On or about 12/08/2023, the employer exposed an employee to struck-by hazards, in that head protection was not provided to an employee engaged in water line work inside a trench exposed to overhead spoil piles.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) Excavation located at 4752-4792 Pittman Road, Cumming, GA 30040: On or about 12/08/2023, the employer exposed employees to cave-in/engulfment hazards while working inside a trench which measured 5-feet, 4 inches deep by 5 feet, 6-inches wide by 50-feet long, in that safe means of egress was not provided to employees installing a new cast iron water pipe.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a) Excavation located at 4752-4792 Pittman Road, Cumming, GA 30040: On or about 12/08/2023, the employer exposed an employee to cave-in/engulfment hazards while working inside an excavation which measured 5-feet, 4-inches deep by 5-feet, 6-inches wide by 50-feet long, in that in that the large 3 to 4-ft., spoil piles were not kept back from the excavated edge at least 2-feet before allowing an employee to engage in water pipe installation inside the trench.
