OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement hazards:  (a)Steve Thomas Construction, at 3328 Ping Drive, Rapid City, SD 57703:  On or about and at times prior to December 7, 2023, the employer did not ensure that employees were protected from impalement hazards while working above areas with exposed concrete encased threaded steel rods.  This condition exposed employees to impalement hazards.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Steve Thomas Construction at 3328 Ping Drive, Rapid City, SD 57703:  On or about and at times prior to December 7, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards from the main floor to the lower level, impalement hazards from exposed threaded rod, untrained operators of powered industrial trucks, improper personnel baskets, and a lack of training as a result of conducting residential framing activities. These condition exposed employees to a variety of hazards identified on site.

This condition exposed employees to fall hazards greater than six feet.

This condition exposed employees to fall hazards greater than six feet.
