29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: On or about December 8, 2023, at the new constructin site, employees were exposed to cave-in hazard while working in an excavation that was more that 5 feet deep without the use of cave-in protection.
