OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  a) Baker Transfer & Storage, Dry Storage Warehouse Steel Storage Racks: On or about December 11, 2023 and at times prior, employees were exposed to struck by hazards while conducting tasks such as, but not limited to: loading and unloading document boxes from the steel storage racks. The employer failed to secure steel storage racking to the floor, remove damaged steel storage racking components and ensure load ratings are posted to prevent overloading.  b) Baker Transfer & Storage, North Warehouse Steel Storage Racks: On or about December 11, 2023 and at times prior, employees were exposed to struck by hazards while conducting tasks such as, but not limited to: loading and unloading document boxes from the steel storage racks. The employer failed to secure steel storage racking to the floor, remove damaged steel storage racking components and ensure load ratings are posted to prevent overloading.  c) Baker Transfer & Storage, North Warehouse, North Steel Storage Racks: On or about December 11, 2023 and at times prior, employees were exposed to struck by hazards while conducting tasks such as, but not limited to: loading and unloading document boxes from the steel storage racks. The employer failed to secure steel storage racking to the floor, remove damaged steel storage racking components and ensure load ratings are posted to prevent overloading.  d) Baker Transfer & Storage, North Warehouse, South Steel Storage Racks: On or about December 11, 2023 and at times prior, employees were exposed to struck by hazards while conducting tasks such as, but not limited to: loading and unloading document boxes from the steel storage racks. The employer failed to secure steel storage racking to the floor, remove damaged steel storage racking components and ensure load ratings are posted to prevent overloading.  e) Baker Transfer & Storage, Freezer Drive Thru Steel Storage Racks: On or about December 11, 2023 and at times prior, employees were exposed to struck by hazards while conducting tasks such as, but not limited to: loading and unloading pallets of bulk frozen food from the steel storage racks. The employer failed to secure steel storage racking to the floor, remove damaged steel storage racking components and ensure load ratings are posted to prevent overloading.  f) Baker Transfer & Storage, Freezer Steel Storage Racks:  On or about December 11, 2023 and at times prior, employees were exposed to struck by hazards while conducting tasks such as, but not limited to: loading and unloading pallets of bulk frozen food from the steel storage racks. The employer failed to secure steel storage racking to the floor, remove damaged steel storage racking components and ensure load ratings are posted to prevent overloading.

29 CFR  1910.178(g)(2): Battery changing and charging installations for industrial trucks were not provided with facilities for flushing and neutralizing spilled electrolyte:   a) RDM Inc. (dba: Baker Transfer & Storage), material handling vehicle charging areas:  On or about December 11, 2023 and at times prior, employees were exposed to chemical eye burns due to the lack of an eyewash station while working around chemicals such as, but not limited to: acid in batteries on material handling equipment.

29 CFR 1910.159(c)(1)(i): Automatic sprinkler design did not comply with the standard in that it did not provide the necessary water flow for complete coverage in a particular workplace:  a) Pack Room:  On or about December 11, 2023 and at times prior, the employer failed to ensure that the sprinkler heads were free of obstructions that would alter the effectiveness of the sprinkler head.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)  RDM Inc. (dba: Baker Transfer & Storage):  On or about December 11, 2023 and at times prior, employees were exposed to chemical hazards while storing chemicals including, but not limited to: nickel oxide (R-67-7H Catalyst), aluminum oxide (KF-757, KF-760, KF-767), sulfonated divinylbenzene/styrene copolymer NA ion form (AMBERLITE 200C NA Ion Exchange Resin), nickel oxide (TK-551), Polymeric MDI and Mehtylene diphenyl diisocyanate (THERMOSEAL A-SIDE). The employer failed to ensure employees were provided with information and training on chemicals with which they may come into contact with in the event of a spill or a leak.
