29 CFR 1910.28(b)(1)(i)(C): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by a personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: Location: a) Worksite; Front of building; Top of awning. a) On or about 12/12/2023, the employer did not ensure that employees were protected from falling by using guardrail systems, safety net systems, and/or personal fall arrest systems. An employee walked/worked near the exposed edge of the awning, which was approximately 12 feet above the concrete sidewalk below, to perform work such as re-roping the flagpole and installing new flagpole cleats without the use of fall protection.
