OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from improperly placed pneumatic nail guns. (a) Worksite: On or about 12/12/2023, an employee was exposed to struck-by type hazards from an improperly secured Bostich Pneumatic Nailer that was still connected to its air supply.

29 CFR 1926.452(w)(6)(i): Employee(s) were allowed to ride on scaffolds when the surface on which the scaffold was moved was not within 3 degrees of level, and/or not free of pits, holes, and obstructions. (a) Worksite - Interior: On or about 12/13/2023, an employee was exposed to struck-by, struck-against and fall type hazards while positioned on the deck of a Metaltech 6-foot baker scaffold as coworkers pushed the scaffold across an uneven floor surface with obstructions.
