Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazards of fire and/or explosion: Filling Room, Panel #2 - On or about December 13, 2023, adequate steps were not taken to avoid fire and explosion hazards, during the mixing of oxidant fuels, in the following instances: a) The flow rate was not controlled to avoid adiabatic compression. b) The model SS-44F4 ball valves used in the mixing panel were not specified for oxygen use. c) A hazard and operability study of the mixing panel was not conducted by a qualified person. d) The gas mixing panel was not designed by a qualified person.

29 CFR 1910.132(a): Protective equipment, including protective shields and barriers, were not used when necessary or whenever hazards capable of causing injury and impairment were encountered: Filling Room, Panel #2 - On or about December 13, 2024, the employer failed to protect workers from the hazards of fire and explosion by the use of a barrier between the operator and source when blending gases capable of producing such hazards.

29 CFR 1904.32(a)(1): A review of the OSHA Log of Recordable Work-Related Injuries and Illnesses (OSHA Form 300 or equivalent) was not completed to ensure the Log was accurate and complete, and/or deficiencies were not identified and corrected at the end of each calendar year: On or about January 19, 2024, the employer signed the summary indicating that all entries were complete and accurate when the following errors were present: a) The incorrect year was entered on the top of pages 2 and 3. b) The number of injuries or illnesses resulting in job restriction or transfer listed on the 300A Summary did not match the 300 Log. c) The total number of injuries listed on the 300A Summary did not match the 300 Log. d) Column F entries for case numbers 1-7, 9, 10, 12, 13, and 15 did not meet the requirements. e) Case number 1 does not list a location where the event occurred.
