29 CFR 1910.1053(d)(3)(iv): Where the most recent exposure monitoring indicated that employee exposures were above the PEL, the employer did not repeat such monitoring within three months of the most recent monitoring: a) Facility: On or about December 14, 2023, the employer had previously documented employee exposure above the permissible exposure limit for respirable crystalline silica while performing cutting on concrete, and has not performed repeat monitoring within 3 months of the most recent monitoring. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
