29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a) 801-809 Bennett Street, Wilmington, DE 19801: On or about December 14, 2023, employees and subcontractor's employees worked on site to conduct framing operations and were exposed to multiple hazards including but not limited to falls, burns, and caught in hazards which had not been identified due to the lack of programs that provided for frequent and regular inspections made by a competent person.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) 801-809 Bennett Street, Wilmington, DE 19801: On or about December 14, 2023, employees and subcontractor's employees observed working and conducting roofing activities on a flat roof, at heights approximately 22 feet above the lower level, without fall protection.  The Damarques Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1488456, citation number 1, item number 1 and was affirmed as a final order date March 19, 2021, with respect to a workplace located at Lots 1, 18, 29 Hamptons Hills subdivision, Camden-Wyoming Delaware.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:  a) 801-809 Bennett Street, Wilmington, De 19801: On or about December 14, 2023, employer did not ensure employees conducting roofing activities used an extension and straight ladders that extended at least three feet above the upper landing, exposing them to falls.  The Damarques Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1530796, citation number 1, item number 2 and was affirmed as a final order on 12/06/2021, with respect to a workplace located at Lot #9 Autumn Ridge Development Milford, De 19963.
