29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented:  On or about December 11, 2023, employees were performing framing activities on the fourth floor of an apartment under new construction without the use of a fall protection system, exposing the employees to a fall hazard of approximately 40 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about December 11, 2023, and at times prior thereto, employees were framing an apartment complex without the employer providing fall protection training, exposing employees to a fall hazard of up to 40 feet.
