OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards associated with inadequately maintained racking systems: a) Freezer 1 - On or about December 15, 2023, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets of frozen food on a damaged steel racking system that had bent upright columns, bent or missing cross members, and missing anchor bolts. b) Freezer 4 - On or about December 15, 2023, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets of frozen food on a damaged steel racking system that had bent upright columns, bent or missing cross members, and missing anchor bolts. c) Freezer 5 - On or about December 15, 2023, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets of frozen food on a damaged steel racking system that had bent upright columns, bent or missing cross members, and missing anchor bolts. d) Freezer 6 - On or about December 15, 2023, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets of frozen food on a damaged steel racking system that had bent upright columns, bent or missing cross members, and missing anchor bolts. e) Freezer 7 - On or about December 15, 2023, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets of frozen food on a damaged steel racking system that had bent upright columns, bent or missing cross members, and missing anchor bolts. 29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees: a) Eastern Dock - On or about December 15, 2024, employees using the stretch-wrapping machine on the eastern end of the loading dock were exposed to a shock hazard of approximately one-hundred and ten (110) volts because the power cord was observed to be damaged such that live wiring was exposed. Abatement Certification Required.
