29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about December 15, Angel Guerrero Esquivel DBA Dos Amigos Construction did not ensure that at least 2 employees utilized appropriate eye protection when exposed to eye hazards from flying particles while using a pneumatic nail gun in a worksite at 2010 Great Oak Boulevard in Wentzville, Missouri.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net system, or personal fall arrest system.  On or about December 15, 2023, Angel Guerrero Esquivel DBA Dos Amigos Construction did not ensure that five employees roofing a two-story tall residential building at 2010 Great Oaks Boulevard in Wentzville, Missouri, were protected from falls by guardrail systems or personal fall arrest systems.

29 CFR  1926.59: The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about December 15, 2023, Angel Guerrero Esquivel DBA Dos Amigos Construction did not develop, implement, and maintain at each workplace a written hazard communication program that at least described how the criteria specified in paragraphs (f) for labels and other forms of warning, (g) for SDSs, and (h) for employee information and training would be met.
