29 CFR 1926.602(d):The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. and as referenced by the note contained in 1926.602(d). Location: Front side of worksite located at 1439 Main St. Brewster, MA. On or about 12/19/23 employee operating a JCB Lull did not have the proper training or license to operate the machine. The employee struck a fabricated framed scaffold that was 3 sections high with an employee assembling the scaffold. The scaffold tipped over sending the employee assembling the scaffold to the hospital by med flight. CSHO was notified by the Brewster Fire Department.
