29 CFR  1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about December 20, 2023, the employer performing concrete cutting with a walk behind saw, at 109 West Main St, Sun Prairie, WI 53590 did not properly implement engineering controls specified for the task in Table 1.   a) The employer used a vacuum system instead of a water delivery system, as required in Table 1, section (iv), for the indoor use of the walk behind Husqvarna brand concrete saw,   b) The respiratory protection was not properly worn, as required in Table 1, section (iv), in that the employees did not have the bottom strap in place and they had facial hair that interfered with the seal.  In the alternative  29 CFR  1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  On or about December 20, 2023, the employer performing concrete cutting with a walk-behind saw, at 109 West Main St, Sun Prairie, WI 53590 did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. 29 CFR  1926.1153(i)(2)(i):  The employer did not ensure that each covered employee could demonstrate knowledge and understanding of at least the information contained in paragraphs (A) - (F) of this section.  On or about December 20, 2023, the employer did not ensure that each employee exposed to silica could demonstrate knowledge and understanding of the health hazards associate with exposure to silica, such as silicosis, lung cancer, chronic obstructive pulmonary disease, immune system effects, and kidney disease.

29 CFR  1926.1153(g)(3): The employer did not make the written exposure control plan readily available for examination and copying, upon request, to each employee covered by this section, their designated representatives, the Assistant Secretary and the Director:  On or about December 20, 2023, the employer performing construction work at 109 West Main St, Sun Prairie, WI 53590, did not provide OSHA with a readily available copy of the written exposure control plan for employees working in the underground parking garage.
