29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   (a) Stone fabrication area - On or about December 19, 2023, the employer did not develop and implement a hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:   1) Requirement for labeling of containers of hazardous chemicals;  2) Safety data sheet availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be present in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employees were exposed to hazardous chemicals such as, but not limited to, M S International, Inc. engineered stone products (contains crystalline silica), W. M. Barr Klean-Strip Acetone (contains acetone), and propane torches (contains propane).  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(g)(1):  Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:    a) Stone fabrication area - On or about December 19, 2023, the employer did not maintain in the workplace copies of the required safety data sheets for M S International, Inc. engineered and natural stone products (contains crystalline silica), W. M. Barr Klean-Strip Acetone (contains acetone), and propane torches (contains propane), and ensure that they were readily accessible to affected employees.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(h)(2): The employer did not provide employees with effective information on hazardous chemicals in their work area at the time of their initial assignment and whenever a new chemical hazard the employees have not previously been trained about was introduced into their work area. Employees were not informed of the following: the requirements of this section; any operations in their work area where hazardous chemicals are present; and, the location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets as required by this section:  (a) Stone fabrication area - On or about December 19, 2023 - The employer did not inform employees of the hazards associated with chemicals with which they were working.  Employees were exposed to hazardous chemicals such as, but not limited to, M S International, Inc. engineered stone products (contains crystalline silica), W. M. Barr Klean-Strip Acetone (contains acetone), and propane torches (contains propane).  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv):  (a) Stone fabrication area - On or about December 19, 2023, the employer did not train employees in at least the following:   1) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); 2) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; 3) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, 4) The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.   Employees were exposed to hazardous chemicals such as, but not limited to, M S International, Inc. engineered stone products (contains crystalline silica), W. M. Barr Klean-Strip Acetone (contains acetone), and propane torches (contains propane).  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
