29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11 of this section). a) New GA Plant: On or about December 19, 2023, and times prior, the employer exposed employees to fall hazards, in that the parapet wall in front of the Hopper was approximately 2.1 feet (25 inches) tall while employees were tasked with removing the grey sand that had packed inside the hopper without requiring the use of fall protection systems.
