29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) Building B: On December 14, 2023, the controlling employer failed to ensure that its subcontractor protected its employees from falls while installing roof shingles on the ridge and eave. Employees were exposed to falls ranging from 29.4 feet to 43.8 feet. b) Building C: On December 14, 2023, the controlling employer failed to ensure that its subcontractor protected its employees from falls while installing walls on the second floor. Employees were exposed to falls from 20.5 feet. c) Building B: On December 15, 2023, and at times prior to; the controlling employer failed to ensure its subcontractor protected its employees from silica while cutting James Hardie plank siding containing 40 percent silica while using a Makita radial and a DeWalt radial saw with a 7 1/4" HardieBlade which did not have a dust collection system, creating dust clouds in the air. Note* Abatement certification AND documentation is required for this item.
