29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: On or about December 20, 2023, there was evidence found that the competent person onsite failed to remove themselves and an employee from a situation that could've resulted in a cave-in. The competent person was working in a trench located at 8912 Kinsman Road, CLEVELAND, OH 44101, 7-feet below the ground without the use of any protective systems.

Schafer Excavating, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2), which was contained in OSHA inspection number 1467632, citation number 1, item number 1 and was affirmed as a final order on 05/11/2020, with respect to a workplace located at 3440 Center Road, Brunswick, Ohio 44212.
