29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied. a) On or about and at times prior to December 20, 2023, at the previously addressed inspection site, a JLG skytrak telehandler that supported a platform was moved horizontally while the platform was occupied by employees, exposing employees to falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). a) On or about and at times prior to December 20, 2023, at the previously addressed inspection site, employees framing and installing fascia on a residential building at heights of 6 feet or more below lower levels were exposed to falls. TJ Construction & Realty, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or a substantially similar Occupational Safety and Health Standard, 1926.501(b)(13), which was contained in OSHA inspection number 1399002, citation number 1, item number 1 and was affirmed as a final order on 2-3-2020, with respect to a workplace located at 6255 Fountainhead Circle, De Forest, WI 53532.
