OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about December 11, 2023, in the Vault Production Area, employees were exposed to a struck-by hazard while utilizing an underhung bridge and trolley with job-made lifting devices under the hoist to move concrete filled vault molds. The lifting devices were deformed, unmarked and used without taglines. There was no documentation of load tests or hoist inspections.

29 CFR 1910.184(f)(4)(ii): All welded end attachments shall not be used unless proof tested by the manufacturer or equivalent entity at twice their rated capacity prior to initial use. The employer shall retain a certificate of the proof test, and make it available for examination. a) On or about December 11, 2023, in the Vault Production Area, employees used a lifting device that was not proof tested.
