29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Worksite, 20 Broadway Massapequa, NY, 11758- Employees on site were working on leveling a 35-foot chimney on a commercial building. A worker on the lower level was exposed to falling debris from the chimney and was not wearing a protective helmet; on or about December 19, 2023. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system a) Worksite 20 Broadway, Massapequa, NY, 11758- Employees on site were leveling a chimney on a multi-purpose commercial building with a flat top roof approximately 25-feet in height. An employee was on top of the chimney approximately 35-feet above the ground and was exposed to the unprotected edge without the use of a guardrail system, safety net system, or personal fall arrest system; on or about December 19, 2023. b) Worksite 20 Broadway, Massapequa, NY, 11758- Employee was working on a flat commercial roof approximately 25-feet above the ground and 15-feet above a lower level. Employee was lowering construction debris with a rope and bucket to the lower level. The employee was exposed to fall hazards without the use of a guardrail system, safety net system, or personal fall arrest system; on or about December 19, 2023. c) Worksite 20 Broadway, Massapequa, NY, 11758- Employee was working on the edge of a flat commercial roof approximately 10-feet above the ground while dumping buckets of construction debris into a garbage shoot. The employee was exposed to fall hazards without the use of a guardrail system, safety net system, or personal fall arrest system; on or about December 19, 2023. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
