29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about December 14, 2023, the employer did not ensure the guarding on the AccurShear was designed and constructed to prevent employee(s) from placing any part of their body in the danger zone during the operating cycle. The guarding was designed in such a way that employee(s) fingers could be placed under while feeding material into the AccurShear near the Assembly department. This action allowed for the material hold-downs to make contact with the employee's fingers resulting in broken bones and partial amputations. Abatement completed during inspection.
