29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. a. On or about December 03, 2023, the employer did not ensure the safe condition of the Milwaukee, 4 1/2 Grinder, S/N C27ED214402157, when an employee operated the grinder to complete the fabrication cutting task for the Fibergrate, FG Corvex, Green 2" thick 2" sq mesh. The guard was removed from the grinder and was equipped with an oversized 6-inch cut-off wheel, thereby exposing the employee to stuck-by hazards.

29 CFR 1910.243(c)(3): Vertical portable grinders. Safety guards used on machines known as right angle head or vertical portable grinders shall have a maximum exposure angle of 180 deg., and the guard shall be so located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator. (See Figure P-4.) (For Figure P-4, http://www.osha.gov/OshStd_gif/10PFP_4.gif) a. On or about December 3, 2023, the employer did not ensure that employees who resized the grinding wheel on a Milwaukee 4 ? Grinder also replaced the guard with one that was appropriately sized for the new wheel when cutting Chemgrate.
