29 CFR  1910.1053(d)(3)(i):Scheduled monitoring option. (i) The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area. Where several employees perform the same tasks on the same shift and in the same work area, the employer may sample a representative fraction of these employees in order to meet this requirement. In representative sampling, the employer shall sample the employee(s) who are expected to have the highest exposure to respirable crystalline silica.  On or about December 21, 2023, the employer failed to provide employees working in proximity with respirable crystalline silica with an initial monitoring assessment to determine the levels of exposures for those employees, exposing them to potential health effects such as silicosis.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

(i) The employer did not establish and implement a written exposure control plan that contains elements listed in paragraph (f)(2)(i)(A) through (f)(2)(i)(C):  On or about December 21, 2023, the employer did not establish and implement a written exposure control plan for  employees working in proximity to respirable crystalline silica.  Employees were exposed to potential health hazards such as silicosis.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1910.1053(i)(1)(i): Medical surveillance-(1) General. (i) The employer did not make medical surveillance available at no cost to the employee, and at a reasonable time and place, for each employee who will be occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year.  On or about December 21, 2023, an employee polishing manufactured countertops was exposed above the action level for respirable crystalline silica (8-hour time-weighted average equal to 25 ug/m3.  Time sampled was 361 minutes with a zero increment for 119 minutes not sampled).  Medical surveillance was not provided by the employer,  exposing them to health hazards such as silicosis.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  On or about December 21, 2023, employees were polishing manufactured countertops to perform quality assurance. The employer did not develop, implement and maintain a written hazard communication program for employees working in proximity to respirable crystalline silica, exposing them to health hazards such as silicosis.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
