29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) Coastal Granite and Marble, 14 American Way #7 Spotswood NJ 08884  On or about 12/21/2023 and thereafter, employee(s) were provided and required to use air-purifying respirators, such as 3M N95 masks, for which the employer did not have a written program for administering the use of respiratory protection in the workplace.  The employer required employees to wear respirators while operating saws to cut marble and granite slabs, as well as polishing and/or grinding of cut countertop pieces using hand-held power tools.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) Coastal Granite and Marble, 14 American Way #7 Spotswood NJ 08884  On or about 12/21/2023, and thereafter, employee(s) were provided and required to use air-purifying respirators, such as 3M N95 masks, for which the employer did not provide a medical evaluation to employees to determine their ability to use a respirator before requiring use. The employer required employees to wear respirators while operating saws to cut marble and granite slabs, as well as polishing and/or grinding of cut countertop pieces using hand-held power tools.

(a) Coastal Granite and Marble, 14 American Way #7 Spotswood NJ 08884  On or about 12/21/2023 and thereafter, employee(s) performed duties that may reasonably be expected to expose them to respirable crystalline silica at or above the action level, which included operating saws to cut granite & marble slabs, polishing, drilling  & finishing stone countertops using hand-held power tools, and ancillary tasks such as opening bags of quartz, and changing filters. Employee(s) were not provided information & training including silica health hazards, tasks posing risk of exposure, control measures in use and provisions of the OSHA Standard.
