29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system. (a) On or about December 20, 2023, the employer did not ensure that each employee working on the flat roof of a warehouse, approximately 37 ft above a lower level where leading edges were under construction, but who were not engaged in the leading edge work, were protected from falling by a guardrail system, safety net system, or personal fall arrest system. This condition resulted in an employee falling approximately 37 feet. Note: If a guardrail system was chosen to provide the fall protection, and a controlled access zone had already been established for leading edge work, the control line may be used in lieu of a guardrail along the edge that parallels the leading edge.

29 CFR 1926.502(h)(1)(i): The safety monitor was not competent to recognize fall hazards: (a) On or about December 20, 2023, the employer did not ensure that employees were protected from injury while installing insulation on a flat roof of a commercial building, in that the employer attempted to utilize a safety monitoring system on a section of the roof adjacent to the leading edge. The safety monitor directed workers to place roofing materials, necessary to installation activities, directly adjacent to the leading edge, outside the safety lined area. This condition resulted in an employee falling approximately 37 feet to the lower level.

The safety monitor was conducting work along with the other employees on that roof section. This condition resulted in an employee falling 37 feet to the lower level.
