29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems.   On or about December 20, 2023, employees were exposed to a fall hazard of approximately 8-10 feet during the offloading of metal tubing from the flatbed of a delivery tractor/trailer. Employees step off of a set of rolling stairs and on top of the metal tubing to locate the center lifting point to attach a sling.

29 CFR 1910.38(f):  The employer did not review the emergency action plan with each employee covered by the plan in accordance with 1910.38(f)(1) through (f)(3).  On or about January 5, 2024, the employer had a written emergency evacuation plan in place involving full evacuation in the event of an emergency like a fire, however the employer did not train employees on the plan.

1910.178(l)(2)(ii)  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about January 5, 2024, the employer did not ensure the operators of the powered industrial trucks (Combilift, Models: CL65060 & C6000GST) were properly trained prior to operation.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.  On or about January 5, 2024, the employer did not provide hazard communication training to employees. Employees work with chemicals including, but not limited to: Propane, Hydraulic Oil, Rust Preventative, and Proway 2 lubricant.
