29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   (a) Jobsite at 1336 Illinois Route 59, Naperville, IL 60540 - On or about December 27, 2023, an employee installing fascia from the basket of a S-65 Genie telescopic boom lift, ID 1818R2725, while at a height of eighteen (18) feet was not wearing an approved body belt or other approved fall arrest harness system, thereby exposing the employee to a fall that can result in death.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Jobsite at 1336 Illinois Route 59, Naperville, IL 60540 - On or about December 27, 2023, employees were not provided with personal fall protection equipment while installing metal to the edges of the unprotected Southwest tower roof thereby exposing them to falls of twenty-five (25) feet and higher.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

(a) Jobsite at 1336 Illinois Route 59, Naperville, IL 60563 - On or about December 27, 2023, the employer failed to present fall protection training certifications for employees required to work at heights greater than six (6) feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Jobsite at 1336 Illinois Route 59, Naperville, IL 60540 - On or about December 27, 2023, employees were required to use an extension ladder that was extended only one and a half (1.5) feet, to access the Southwest tower roof from the primary roof, thereby exposing them to falls of six (6) feet or higher.  Abatement is not required of this item.
