29 CFR 1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (1): The nature of any electrical hazards, fall hazards and falling object hazards in the work area; a) On or about December 19, 2023, the employer failed to ensure that employees were trained by a qualified person in fall hazard recognition for the use of mobile scaffolds. Employees were exposed to fall hazards greater than 8 feet to the concrete below while using a chemical tote as a forklift man basket to reach the ceiling mounted LiftMaster garage door opener.

29 CFR 1910.178(o)(1):Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered. a) On or about December 19, 2023, the employer did not ensure that stable loads were being handled by the operator of the Clark forklift. As a result, employees were exposed to fall hazards greater than 8' to the concrete floor below.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a) On or about December 19, 2023, the employer did not receive written prior approval from the manufacturer before allowing a homemade manlift attachment to be utilized on the Clark C500-40 forklift by maintenance employee to reach an overhead LiftMaster garage door opener. As a result an employee fell 8'4" to a concrete floor and was hospitalized.
