29 CFR 1926.502(e)(2): Positioning devices were not secured to an anchorage capable of supporting at least twice the potential impact load of an employee's fall or 3,000 pounds (13.3 kN), whichever was greater: On or about December 27, 2023, and at times prior, the employer did not ensure that employees conducting formwork removal were tied-off to an anchor capable of supporting at least twice the potential impact load of an employee's fall or a designated anchorage point. Employees were exposed to falls greater than 6 feet, in that an employee was tied off to the panel and the employee fell when the panel fell, more than 17 feet. The employee had broken bones and was hospitalized.

29 CFR 1926.703(a)(1): Formwork was not designed, fabricated, erected, supported, braced and maintained so that it would be capable of supporting without failure all vertical and lateral loads that could reasonably be anticipated to be applied to the form: On or about December 27, 2023, and at times prior, employees were exposed to struck by hazards and falls greater than 6 feet due to improper installed formwork panels. The employer failed to ensure that the Ellis formwork panel's were supported and maintained in a way that would not allow them to fail, causing an employee to fall and a heavy panel (200+ pounds) to fall. The employee was tied off to the panel and the employee fell when the panel fell, more than 17 feet. The employee had broken bones and was hospitalized.
