29 CFR 1926.760(b)(3):Be provided, at heights over 15 and up to 30 feet above a lower level, with a personal fall arrest system, positioning device system or fall restraint system and wear the equipment necessary to be able to be tied off; or be provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section. a) 6826 Black Horse Pike, Egg Harbor City NJ: Employees were not protected against fall hazards. Employees were performing decking at a height of approximately nineteen feet above the ground and did not have any means of fall protection available during the decking activity such but not limited to the ability to tie off and utilize fall protection. Observed on or about 12/29/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
