29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Location at 5600 Trabue Road, Columbus Ohio 43228: On or about January 3, 2024, the employer did not initiate and maintain safety and health programs related to the work that was being performed on the jobsite to included work rules, hazard detection and site safety enforcement. The employees were working at heights of up to approximately 50 feet without any type of fall protection in place and working below a load of material using pneumatic nail guns and circular saws without any head or eye protection in place, thereby exposing the employees to falls and struck by hazards on the jobsite.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Location at 5600 Trabue Road, Columbus Ohio 43228: On or about January 3, 2024, the employer did not instruct employees working onsite on the recognition and avoidance of hazards associated with the construction work being performed at the job site that exposed the employees to falls and struck-by hazards. Thereby exposing the employees to struck-by hazards to the eyes and head and fall hazards from an aerial lift and up to approximately 50 feet from the roof.

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a. Location at 5600 Trabue Road, Columbus Ohio 43228: On or about January 3, 2024, the employer did not ensure that employees working below a load of materials elevated by a forklift while installing a water barrier from a articulating boom lift utilized head protection. Employees were thereby exposed to struck-by hazards associated with falling materials from approximately 8 feet above them.

Located at 5600 Trabue Road, Columbus, Ohio, 43228: On or about January 03, 2024, the employer failed to ensure the employees were wearing appropriate eye protection while operating pneumatic nail guns to install roof sheathing and Tyvek commercial wrap on a new build three story hotel building.

29 CFR  1926.453(b)(2)(iv):Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.  a. Location at 5600 Trabue Road, Columbus Ohio 43228: On or about January 3, 2024, the employer did not ensure that employees using an aerial lift stood firmly on the floor of the basket and did not climb on the rails of the basket. Employees were observed operating a JLG articulating aerial boom lift to install vapor barrier on the outside of a new build 4 story hotel. The employees were observed climbing the side rails of the articulating aerial boom lift to secure the barrier to the sheathing thereby exposing the employees to falls of  approximately 20 feet.

29 CFR  1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a. Location at 5600 Trabue Road, Columbus Ohio 43228: On or about January 3, 2024, the employer did not ensure employees were protected from falls while working from aerial lifts. Employees were working from an articulating boom aerial lift without any type of fall arresting system in place while installing water and vapor barrier protection on the exterior walls of a new build hotel, thereby exposing the employees to a fall hazard of up to approximately 20 feet.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a. Location at 5600 Trabue Road, Columbus Ohio 43228: On or about January 3, 2024, the employer failed to ensure the employees were protected from falling while installing sheathing on a new build four story hotel. The employees were exposed to heights of up to approximately 50 feet from the roof edge to the ground below.
