29 CFR  1910.37(a)(3): Exit routes were not kept free and unobstructed.  Materials or equipment were placed, either permanently or temporarily, within the exit route.  a). Hearthside Food Solution, LLC on or about February 2, 2024 at the location of 312 Rader Rd, Mc Comb, OH 45858: The employer did not ensure all  exit routs were unobstructed. Due to this condition, employees tasked with working on the Graham Cracker Line (Line 9) Wrapper A and B were required to pass under permanent conveyers approximately 4' from ground level to access emergency exits. Employees working in this condition were exposed to deficient emergency evacuation access subjecting them to potential injury.

1910.147(c)(2)(ii):  The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.  a). Hearthside Food Solution, LLC on or about February 2, 2024 at the location of 312 Rader Rd, Mc Comb, OH45858: The employer did not certify that the periodic inspection included a review, between the inspector and each authorized employee, of that employee?s responsibilities under the energy control procedure being inspected.

Hearthside Food Solution, LLC on or about January 3, 2024 at the location of 312 Rader Rd, Mc Comb, OH 45858: The employer did not ensure established lockout procedures were done in sequence to protect employees tasked with cleaning and unjamming  Graham Cracker Line (Line 9) Wrapper A. Due to this condition they were exposed to a pinch point hazard created by the Jaw Sealers.

Hearthside Food Solution, LLC on or about February 2, 2024 at the location of 312 Rader Rd, Mc Comb, OH 45858: The employer did not ensure the nip point created between the Wrapper BB outfeed conveyor and tension roller on the Graham Cracker Line (Line 9) was adequately guarded. Employees performing in-operational cleaning of the machine in proximity of the un guarded nip point were exposed to caught-in hazards.   b). Hearthside Food Solution, LLC on or about February 2, 2024 at the location of 312 Rader Rd, Mc Comb, OH 45858: The employer did not ensure the nip point created between the Wrapper A outfeed conveyor and tension roller on the Graham Cracker Line (Line 9) was adequately guarded. 29 CFR  1910.303(g)(2)(i):Except as elsewhere required or permitted by this standard, live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures.  a). Hearthside Food Solution, LLC on or about January 3, 2024 at the location of 312 Rader Rd, Mc Comb, OH 45858: The employer did not ensure the energized conductors (240v wire braid) on Wrapper A of the Graham Cracker Line were adequately enclosed. Employees performing operational duties, such as but not limited to, cleaning and machine adjustments in proximity of the conductors were exposed to shock hazards.
