29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury: a) New residential construction on #Lot 266 929 Melville Drive and Lot #257 Orwell Drive Stockbridge, GA 30281, Roof: On or about 01/04/2024, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees engaged in roofing activities operating these tools at 130 PSI.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) NOTE TO CSHO: USE THIS OPTION WHEN THE EMPLOYER (1) FAILED TO SATISFY THE SECTION 501(B)(13) REQUIREMENTS, AND (2) FAILED TO PROVE INFEASIBILITY/GREATER HAZARD AND/OR FAILED TO DEVELOP AND IMPLEMENT A SATISFACTORY FALL PROTECTION PLAN UNDER 1926.502(K). PLEASE DESCRIBE THE FALL PROTECTION PLAN DEFICIENCIES IN YOUR AVD. A) On or about 1/04/2024, during the installation of roofing material on a newly constructed residential property located at Lot #266 929 Melville Drive and Lot #257 Orwell Drive Stockbridge, GA 30281 , the employer failed to ensure that employees were protected from fall hazards by conventional fall protection and/or devices. Employees were exposed to fall hazards from heights of approximately approximately20 feet, 3inches, and 10 feet, 9 inches from the top of the roof to ground level.
