OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about January 4, 2024, employees were exposed to fall hazards when utilizing a scissor lift to access the ceiling area to attach ropes to raise netting by climbing on the guardrails of the lift. Among other methods, feasible and acceptable abatement methods to correct this hazard include the following: comply with the American National Standard for Self-Propelled Elevating Work Platforms (ANSI-SAIA A92.6-2006) Section 7.10 Operator Warnings and Instructions, Paragraph 9 - Personnel Footing. Personnel shall maintain a firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017: On or about January 4, 2024, the employer failed to ensure employees working at heights were properly trained prior to employees being exposed to fall hazards.
