29 CFR1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe; the trucks were not taken out of service until they had been restored to safe operating condition. a) Warehouse: On or about January 5, 2024, the employer did not ensure that a Toyota 48v forklift Model 8FBCU32 was taken out of service due to its emergency brake not holding the forklift in place when placed in gear. b) Warehouse: On or about January 5, 2024, the employer did not ensure that a Toyota LPG forklift Model 8FGCU20 was taken out of service due to its emergency brake not holding the forklift in place when placed in gear.
