OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards: On or about January 4, 2023, Warehouse Area, the employer exposed an employee to fall hazards of 10 feet or greater to the lower ground level, in that a employees were allowed to work from an elevated position on a pallet that was resting on the forks of a CAT DP25K forklift truck that was not secured to the forks or installed into the fork pockets as required by the manufacturer.

29 CFR 1910.157(c)(1): Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries: On or about January 5, 2024, employees were engaged in work activities related to receiving and sorting scrap material where: a) a fire extinguisher in the southwest corner of the warehouse was blocked by materials and not identified. b) a fire extinguisher sitting on the floor under desk in warehouse was not mounted. c) a fire extinguisher on the southeast side of warehouse in between the bay doors was not identified and was obstructed by materials in storage and a scale.
