29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Highway 27 North Lagrange, GA: On or about January 4, 2024, and at times prior, the employer exposed employees to engulfment, struck-by and cave-in hazards, in that, the employer did not instruct employees to recognize and avoid unsafe conditions, such as but not limited working in an unprotected trench, failure to utilize necessary personal protective equipment, failure to avoid working under loads and no safe means of access and egress from the trench.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) Highway 27 North Lagrange, GA: On or about January 4, 2024, and at times prior, the employer exposed employees to cave-in hazards, in that the employer did not ensure there was a safe means of egress for employees working in an unprotected trench. The trench measured approximately 25-feet long, 18-feet wide, and 7-feet deep, contained fissures and had a spoil located at the edge.
