29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about December 21, 2023, at the new Blue Ember Smokehouse job site, employees used a portable ladder to access an excavation greater than 4-feet deep. The unsecured ladder present in the excavation did not extend at least 3 feet above the excavation's edge. Coring & Cutting Services, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1641552, citation 1, item 3 and was affirmed as a final order on July 21, 2023, with respect to a workplace located at 5035 Warden Road, North Little Rock, Arkansas.
