At 5330 SR 16 West, Saint Augustine, FL, on or about January 5, 2024, the employer exposed employees to the hazard of being struck by rolling soil and rocks in that the excavation spoil piles were placed on the leading edge of the excavation without any setback distance.

29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe, or defective rigging equipment removed from service a. At 5330 SR 16 W, Saint Augustine, Florida, on or about January 5, 2024, the employer exposed employees to struck-by hazards while lifting drainage pipes in that the lifting hook attached to the excavator bucket was missing the flipper safety latch.
