29 CFR 1910.106(e)(6)(ii): Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with. a) On or about January 5, 2024, the employer did not ensure that category 2 flammable liquid (waste isopropanol 99%) was being dispensed into a secondary container while being electrically interconnected. As a result, employees were exposed to a fire hazard. b) On or about January 5, 2024, the employer did not ensure that the category 2 flammable liquid (isopropanol 99%) being dispensed during cleaning cycles, from a primary container (55-gallon drum) outside the paint booth to a robotic arm inside the paint booth, were electrically interconnected. As a result, employees were exposed to a fire hazard.

29 CFR 1910.107(e)(2): Flammable liquids and liquids with a flashpoint greater than 199.4F (93C): Quantity. The quantity of flammable liquids or liquids with a flashpoint greater than 199.4 �F (93 �C) kept in the vicinity of spraying operations shall be the minimum required for operations and should ordinarily not exceed a supply for 1 day or one shift. Bulk storage of portable containers of flammable liquids or liquids with a flashpoint greater than 199.4 �F (93 �C) shall be in a separate, constructed building detached from other important buildings or cut off in a standard manner. a) On or about January 5, 2024, the employer did not ensure that quantities of flammable liquids (specifically isopropanol 99%), which exceeded 1 day or one shift's supply, were not kept in the vicinity of the spraying operation (clear-coat paint booth), in that approximately 18 gallons of waste isopropanol 99% was kept in a 55-gallon drum inside the clear-coat spray booth, exposing employees to a fire hazard.

29 CFR 1910.107(b)(5)(vi): Spray Booths: Dry type overspray collectors - (exhaust air filters). In conventional dry type spray booths, overspray dry filters or filter rolls, if installed, shall conform to the following: Clean filters or filter rolls shall be noncombustible or of a type having a combustibility not in excess of class 2 filters as listed by Underwriters' Laboratories, Inc. Filters and filter rolls shall not be alternately used for different types of coating materials, where the combination of materials may be conducive to spontaneous ignition. a) On or about January 5, 2024, the employer failed to ensure that the High-Capacity Supra II filters in the clear-coat paint booth were of a noncombustible type in that the filters being used were non flame-retardant paper based filters (combustible). As a result, employees were exposed to a fire hazard.
